BUDGET 2013-14 VS AUSTRALIAN MIGRATION

เอาเป็นว่าในที่สุดคืนแห่งงบประมาณแห่งชาติ หรือ Budget Night สำหรับปี 2013-2014 ของออสเตรเลียก็ผ่านไปด้วยความทุลักทุเลที่มีตัวเลขติดลบ (deficit) ถึง 19.4 พันล้านเหรียญก็ไม่ทราบว่ารัฐบาลจะไปหาเงินที่ไหนมารองรับการแก้ปัญหาการติดลบตรงนี้  – ประกาศไปอย่างเป็นทางการแล้วโดยท่านรัฐมนตรีคลัง Wayne Swan เมื่อคืนวนที่ 14 May, 2013 สดๆร้อนๆ คุณหมอวีซ่าเองก็ตามข่าวอย่างทันยุค และในฐานะที่เป็นผู้เชี่ยวชาญทางด้านวีซ่าเข้าเมืองของออสเตรเลีย คุณหมอวีซ่าก็คงจะขออนุญาตนำข้อมูลจากสถาบัน Migration Institute of Australia (MIA) ที่เป็นสโมสรหรือสมาคมสำหรับ migration agents ทั้งหลายที่คุณหมอวีซ่าเองก็เป็นสมาชิกอยู่มาเล่าสู่กันฟังอย่างทันข่าวสดๆร้อนๆว่าการประกาศงบประมาณครั้งนี้ของพรรคแรงงานที่นำโดยนายกหญิงจูเลีย กิลลาร์ดนั้นจะมีผลกระทบต่อนโยบายทางด้านวีซ่าและคนอพยพเข้าเมืองของออสเตรเลียอย่างไรนะคะ

2013-14 Budget Overview: Australia’s Migration Program

A preliminary reading of the DIAC Portfolio Budget Statements 2013-14 reveals:

  • Total Migration Program numbers remain unchanged at 190,000; ตัวเลขจำนวนคนที่จะรับเข้าประเทศออสเตรเลียในปีงบประมาณนี้ ไม่มีการเปลี่ยนแปลง คือ 190,000 เท่าเดิม
  • Skilled Program down by 700 places to 128,550; วีซ่าทักษะลดจำนวนไปอีก 700 ที่
  • Family Program up by 700 to 60,885; วีซ่าครอบครัวขึ้น 700 ที่
  • Total departmental revenue is expected to increase from $1,333.7 million to $1,462.3 million. สรุปแล้วตามความเห็นของสื่อหลายฉบับก็ลงกันว่า รัฐบาลชุดนี้ออกงบตามความเชื่อในระบบของตน ไม่ได้ออกตามความอยู่รอดของประเทศชาติ เลยมีการติดลบถึง 19.4 พันล้าน นักธุรกิจก็กังวลกัน เพราะคงจะมาดูดเงินภาษีเพิ่มขึ้นแน่นอน เมื่อเทียบกับการทำธุรกิจก็เปรียบเสมือนมีแต่เงินออก เงินเข้าจะหามาจากไหน ก็ยังไม่มีการระบุที่แน่ชัด สื่อเห็นว่าน่าจะเป็นการสร้างปัญหาภาระหนี้สินให้รัฐบาลชุดต่อไปเข้ามาแก้ไขในการเลือกตั้งที่จะเกิดขึ้นตอนเดือนกันยายนนี้มากกว่า มีคนลงความเห็นว่า การที่รัฐบาลชุดนี้ประกาศเพิกถอนรายการเงินจุนเจือทารก Baby Bonus ออกนั้น หากใครยังอยากได้เงินตรงนี้ (ประมาณ $5,000 ที่รัฐบาลเคยจ่ายให้กับทุกทารกที่เกิดใหม่) คงจะต้องรีบกลับไปทำให้ภรรยาตนท้องภายใน 10 วันหลังคืนที่มีการประกาศงบประมาณแห่งชาติครั้งนี้ ฮาจริงๆค่ะ
อีกช่องทางหนึ่งที่รัฐบาลออสเตรเลียทำเงินก็มาจากวีซ่าสำหรับนักลงทุน ความที่ประเทศออสเตรเลียมีเมืองที่ติดอันดับว่าเป็นเมืองที่น่าอยู่ที่สุดในโลกถึง 4 แห่ง คือ Melbourne, Adelaide, Sydney และ Perth โดยที่ Melbourne ได้รับการจัดอันดับว่าเป็นเมืองที่น่าอยู่ที่สุดในโลกเลยทีเดียวนะคะ

จึงทำให้มีนักลงทุนจากทั่วโลก โดยเฉพาะประเทศจีนที่อยากเอาเงินมาลงทุนซื้อสัญชาติออสเตรเลีย รัฐบาลออสเตรเลียจึงได้ออกวีซ่าที่เรียกว่า Significant Investor Visa ประเภท 888 มาดึงดูดนักลงทุนให้เอาเงินมาทุ่มในประเทศออสเตรเลีย วีซ่าตัวนี้ใหม่มาก และต้องใช้เงินลงทุนถึง 5 ล้านเหรียญ และแล้วเมื่อวันที่ 3 May, 2013 ที่ผ่านมา ท่านรัฐมนตรีเข้าเมือง Brennan
O’Connor  ก็ออกมาประกาศว่าได้ปล่อยวีซ่าตัวนี้ผ่านให้กับนักลงทุนชาวจีนแผ่นดินใหญ่ที่เป็นยักษ์ใหญ่ทางการผลิตของเล่นเด็กเป็นเจ้าแรกแล้ว คุณหมอวีซ่าเลยขออนุญาตนำข่าวที่นำเสนอโดย Migration Alliance ซึ่งเป็นอีกสโมสรหนึ่งที่คุณหมอวีซ่าในฐานะที่เป็น Migration Agent มานานปีตั้งแต่ปี คศ 1998 มาลงให้ท่านผู้อ่านที่คิดว่ามีเงินเหลือใช้ อยากได้วีซ่าถาวรของออสเตรเลียโดยไม่ต้องกังวลเรื่องอายุ ทักษะหรือภาษาอังกฤษ ก็มาพบคุณหมอวีซ่าได้นะคะ จะพยายามช่วยให้ท่านข้ามสะพานไปได้เช่นกันค่ะ

Australia grants first significant investor visa

Brendan O’Connor, Australia’s minister for immigration and citizenship, announced on Friday (May 3) that the first significant investor visa has been granted.

These migration visas were introduced in November last year, and is the newest addition to the Australian Business Innovation and Investment Program.

Its introduction was a strategic move by the government to attract migrants to Australia who have proven themselves to be successful businessmen and women or investors.

“Significant investors bring with them their skills in business, their links to international markets and additional capital for investment in other projects in Australia that interest them,” stated Mr O’Connor.

A large number of people – 170 in total, according to the immigration minister – have applied for significant investor visas so far, representing an approximately $850 million boost in potential investments.

Friday’s successful applicant, who was nominated by the Victorian state government, is a Chinese toy manufacturer, who will be moving to Australia shortly with his young family.

This visa is unique in that applicants do not need to satisfy the innovation points test and there are no upper age limits. There is also no English language threshold.

Potential applicants for the significant investor visa must be nominated by a state or territory government and submit an Expression of Interest through SkillSelect, an online service hosted by the Department of Immigration and Citizenship, before they will be invited to lodge an application for this visa.

The visa dictates that successful applicants must contribute a minimum of $5 million into complying Australian investments and maintain this one-off contribution over four years.

There are three kinds of complying investment, according to the Department of Immigration and Citizenship’s FAQ sheet on the significant investor visa. They are:

  • Direct investment into Australian proprietary companies
  • Government bonds
  • Australian Securities and Investment Commission (ASIC) regulated managed
    funds

The ‘managed funds’ migrants can invest in include, but are not limited to, infrastructure projects and real estate in Australia, agribusiness and a variety of bonds.

This complying investment must be made before eligible applicants are granted their provisional visa.

If significant investor visa holders are able to continue investing the $5 million into the economy for four years, they then become eligible for permanent visas.

“Australia is in active competition with other countries across our region for successful, high wealth individuals and the capital and business acumen that comes with them,” stated Mr O’Connor.

This is why state and territory governments are primarily targeting “the most experienced business people and high-profile investors” with this scheme.

Fact Sheet – Employing Legal Workers

It is the responsibility of all businesses to employ only legal workers.

Legal workers are Australian citizens, permanent residents and people in Australia on valid visas that allow them to work. This includes New Zealand citizens.

Not everyone in Australia is allowed to work. Some Australian visas, for example some visitor visas, do not allow non-citizens to work while in Australia.

Non-citizens who no longer hold a valid visa are also not allowed to work in Australia.

In 2007 it became a criminal offence to employ or refer for work someone who is not allowed to work. This includes both paid and unpaid work.

What’s new?

Infringement notices and civil penalties will be introduced for hiring, contracting or referring for work people who are not allowed to work who are restricted from undertaking certain work.

Businesses will be held responsible for engaging illegal workers, whether they knew they were allowed to work or not. This is unless they can provide evidence they took reasonable steps to prevent that occurring.

Who is affected by the reforms?

All Australian businesses should check that the workers they engage are allowed to work. This is regardless of whether workers are sourced directly or via a contractor, labour hire or referral company.

How can I check if someone is allowed to work?

By using Visa Entitlement Verification Online (VEVO) you can check if someone is allowed to work in Australia. It will also tell you if there are any work limitations associated with a visa, such as a person who holds a working holiday visa who can only work for six months.

VEVO is a secure and free government web-based service. It is the preferred method of checking if non-citizens are allowed to work. VEVO checks can be used as evidence that you have taken reasonable steps to check that someone is allowed to work.

จากบทความข้างต้นนั้น เป็นการกล่าวเชิญชวนให้จ้างลูกจ้างที่มีวีซ่าอย่างถูกต้องตามกฎหมายในการทำงาน แล้วทำไมถึงต้องจ้างลูกจ้างที่มีซ่าทำงานที่ถูกต้องด้วย  นั่นก็เพราะในปัจจุบันนี้อาจจะมีผู้ที ไม่มีวีซ่ามากมายทำงานในออสเตรเลีย โดยไม่ยอมจ่ายภาษี ได้รับเงินสดไปกันแถบๆ ดังนั้นทางรัฐบาลออสเตรเลียจึงได้ออกมาตรการขึ้นมาเพื่อป้องกันนายจ้างทั้งหลายที่ต้องการจะจ้างลูกจ้าง  ถ้าหากต่อไปนี้มีการจ้างลูกจ้างที่เป็นผี หรือมีวีซ่าที่ไม่มีสิทธิในการทำงาน ก็อาจจะโดนปรับ หรือทั้งจำทั้งปรับค่ะ หลายคนคงงงว่าคุณหมอวีซ่านำบทความฉบับนี้มาลงทำไม  ทั้งนี้เพราะในปัจจุบันนี้ม น้องๆจำนวนมากที่ทำงานอย่างไม่ถูกกฎของวีซ่าที่ตัวเองถืออยู่ เช่นบางคนถือวีซ่าท่องเที่ยวแล้วก็เข้ามาทำงาน แทนที่จะได้รับการจ่ายเงินที่ถูกต้องจากนายจ้าง  จากปกติแล้ว ทำงานในร้านอาหารทั่วไปอาจจะได้ชั่วโมงละ 15 เหรียญหรือมากกว่า แต่เมื่อมีวีซ่าที่ไม่ถูกต้อง ก็อาจจะโดนนายจ้างกดเงินให้เพียง 50 เหรียญต่อกะ ซึ่งนับว่าน้อยมากตามอัตราการจ่ายค่าแรงที่ออสเตรเลีย  ในขณ เดียวกันสำหรับผู้ที่ไม่มีวีซ่า หรือเป็นผีอยู่ โอกาสในการได้เงินอย่างถูกต้องตามกฎหมายนั้นก็ยิ่งยากเข้าไปใหญ่ นายจ้างส่วนใหญ่เมื่อเห็นไม่มีวีซ่าก็อาจจะกดเงิน หรือไม่ให้เงิน แล้วถ้าหากไม่พอใจก็อาจจะแจ้งอิมมิเกรชั่นให้มาจับกลับประเทศ  เห็นมั้ยคะว่าการจ้างแรงงานที่ถูกต้องตามกฎหมายนั้นดีกว่าแค่ไหน เพราะฉะนั้นสำหรับทุกคนที่ถือวีซ่าประเภทอื่นๆ เช่นวีซ่านักเรียน วีซ่าท่องเที่ยว แล้วต้องการเปลี่ยนเป็นวีซ่าทำงาน  มีนายจ้างเห็นฝีมือแล้วอยากสปอนเซอร์ต่อ  ก็สามารถเข้ามาพูดคุยได้กับซีพี ทุกสาขาเลยนะคะ เพราะเดี๋ยวนี้ข่าวลือเรื่องวีซ่านายจ้างสปอนเซอร์ (457) นั้นมีหลายกระแสมากมาย  และยิ่งในช่วงหลัง 1 กรกฎาคม 2013 เป็นต้นไป วีซ่านายจ้างสปอนเซอร์จะมีการปรับเปลี่ยนให้ยากขึ้น  อันนี้เหลายความเห็นก็โทษรัฐบาลออสเตรเลียที่นำโดย Julia Gillard ที่อยากจะหาเสียงโดยการนำวีซ่า 457 มาเป็นประเด็น   ตัวอย่างเช่นบริษัท A ดำเนินธุรกิจทางด้านดีไซน์  บริษัท A จะต้องแสดงให้ทางอิมเห็นว่า บริษัทไม่สามารถหาลูกจ้าง local ที่เป็นพีอาร์ หรือซิติเซ่นได แล้ว ถึงจะจ้างลูกจ้างที่เป็นชาวต่างชาติได้  นอกจากนี้เงินเดือนที่นายจ้างจ่ายนั้นก็ต้องในระดับเดียวกับลูกจ้าง local   และอาจจะมีการปรับผลในเรื่องของผลสอบภาษาต่างๆ ซึ่งขณะนี้ยังไม่มีกฎการเปลี่ยนแปลงออกมาที่แน่นอน  เพราะฉะนั้นน้องๆคนไหนที่อยากจะยื่นวีซ่านายจ้างสปอนเซอร์ก็ควรจะรีบยื่นก่อนวันที่ 1 กรกฎาคม 2013 นี้ เพราะถ้าหากมีการเปลี่ยนแปลงกฎแล้ว แน่นอนว่าวีซ่าทำงานก็อาจจะมีโอกาสที่ได้ยากขึ้นอีกค่ะ
